Unjust Detention and the Question of Press Freedom

In Bangladesh, democracy, the rule of law, and press freedom are deeply interconnected. A state can only be considered truly democratic when freedom of expression is guaranteed and journalists are able to report the truth without fear. However, in recent times, the prolonged detention of several journalists without trial has raised serious concerns about these fundamental principles.
The names Shahriar Kabir, Mozammel Babu, Shyamal Dutta, Farzana Rupa, and Shakil Ahmed represent more than just individuals; they symbolize a broader crisis. They have been accused in murder cases filed during the tenure of the interim government. Yet, there is a widespread public perception that they were not directly involved in any Murder. In this context, their prolonged detention is questionable not only from a humanitarian standpoint but also from legal and ethical perspectives.
In any civilized state, there must be a clear distinction between being “under trial” and being “convicted.” Until a person is proven guilty in a court of law, they must be presumed innocent. This is a fundamental principle of international law and human rights. But when a journalist remains imprisoned for two years or more without trial, it is only natural for doubts to arise about the application of this principle.
The recent release of Anis Alamgir has been seen as a positive step by the government. It reflects a humane and compassionate approach. The fact that both the Prime Minister and the President checked on him during Eid is also commendable. Such actions create hope among the public that the government values humanitarian considerations.
However, an important question remains: if such compassion can be shown in one case, why not in others? What are the alleged crimes of Mozammel Babu, Shyamal Dutta, or Farzana Rupa? Why do they remain in custody? These questions are not only raised by their families but by the nation as a whole.
One of the most tragic aspects of this prolonged detention is its impact on families, especially children. Growing up without parents creates deep psychological distress. Financial hardship is also depriving many of these children of educational opportunities, which poses a serious threat to the future generation of the country. No child should have to endure such uncertainty and hardship.
Various non-governmental and human rights organizations have repeatedly urged the government to grant bail to these journalists. However, there are allegations that these appeals have not received due attention. To resolve this situation, it is essential to ensure a transparent and swift judicial process. Justice delayed is justice denied, and this principle applies fully in this case.
The current government seeks to establish itself as a democratic administration. A free press is one of the pillars of democracy. If journalists feel unsafe, if they risk imprisonment for their work, then the foundation of democracy becomes fragile. A strong state must have the capacity to accept criticism.
The international context is also relevant here. Organizations such as the Committee to Protect Journalists (CPJ) have highlighted in their recent reports that journalists in many countries face harassment, arrest, and prolonged legal proceedings. Their findings indicate that arbitrary detention, misuse of digital security laws, and political pressure are increasingly restricting the working environment for journalists.
Similarly, Reporters Without Borders (RSF), in its World Press Freedom Index, has warned of rising pressure on journalists in several South Asian countries. Organizations like Amnesty International and Human Rights Watch have also stated that prolonged detention without trial is a clear violation of human rights.
Another important aspect is the impact on media institutions themselves. Shyamal Dutta has long been associated with the daily newspaper “Bhorer Kagoj.” His absence is not just the loss of a position; it is the absence of an experienced voice that played a crucial role in editorial direction, news selection, and maintaining professional standards. The continuity and credibility of a newspaper often depend on such experienced professionals.
The same applies to Mozammel Babu, Farzana Rupa, and others. Each has contributed significantly to their respective institutions through years of experience, professional networks, and journalistic skills. Their sudden absence is affecting the quality of news gathering, analysis, and presentation. While new journalists may eventually fill the gap, it takes time, leaving institutions in a subtle but real crisis.
In the context of Bangladesh, these international and domestic realities become even more significant. As a developing country, its global image depends greatly on the freedom and professionalism of its media.
This situation presents an important opportunity for the government. By releasing these journalists, it would not only take a humanitarian step but also send a positive message to the international community that Bangladesh truly upholds the rule of law and freedom of expression.
This should not be treated as a political issue. It is a moral and humanitarian concern. The role of a journalist is to present the truth, highlight social inconsistencies, and act as the voice of the people. If they are persecuted for doing so, it harms not only individuals but society as a whole.
We envision a Bangladesh where journalists can work without fear, where the rule of law applies equally to all, and where no family has to suffer the pain of losing a loved one to unjust detention.
Therefore, the time has come for a bold and just decision. By ensuring the release of these journalists, the government can send a strong message to the nation that it stands for justice, humanity, and freedom.
This is not just about the release of a few individuals; it is about the future of democracy, human rights, and press freedom in Bangladesh. The nation now awaits that decision.
