Leave to appeal dismissed : case against Dr Yunus to continue

The Appellate Division has dismissed the leave to appeal of Grameen Telecom chairman Nobel Laureate Dr Muhammad Yunus against the dismissal of the application for quashing the case of violation of labor law. As a result, there is no obstacle to continue the case against Dr Yunus in the labor court, lawyers said.

On Monday (May 8), the Appellate Division led by Senior Justice M. Nuruzzaman gave this order.

Lawyer Abdullah Al Mamun was in favor of the application in the court. The lawyer was on behalf of the Department of Inspection of Factories and Institutions. Khurshid Alam Khan. Attorney General AM Amin Uddin represented the state.

Earlier, after the hearing in this matter on April 3, May 8 was fixed for the order.

On August 17 last year, the High Court bench of Justice SM Quddus Zaman and Justice Fahmida Quader dismissed the ruling issued by Yunus's application to dismiss the case. Then Dr. Muhammad Yunus appealed to the Appellate Division.

On September 9, 2021, in the Third Labor Court of Dhaka, Arifuzzaman, the labor inspector of the Directorate of Factories and Institutions, became the plaintiff. He filed this case against four people including Yunus.

In addition to Yunus MD. Ashraful Hasan, Director Nurjahan Begum and Md. Shah Jahan was made a defendant in the case.

In the case, allegations were made under Section 4 of 7, 8, 117 and 234 of the Labor Act for non-deposit of certain dividends to the Sramik Kalyan Foundation, non-permanent employment of workers, non-encashment of public holidays. Later an application was made to the High Court challenging the validity of the case.

On December 12 of the same year, the High Court suspended the case proceedings and gave a ruling. The State then appealed to the Appellate Division.

After the hearing of that application, the ruling issued to dismiss the case was ordered to be settled within two months. The proceedings of the case will be suspended till this time. After hearing that rule, the High Court gave its verdict on August 17 last year.
